Terms & Conditions
The general conditions of sale, shown below, are valid and accepted in full for any order received by SP Sas (owner of the SECRET GARDEN trademark) and constitute an essential part of each order. All commercial relationships between SP Sas and customers are governed exclusively by the following general conditions of sale, excluding any other agreement, unless agreed in writing.
1. METHOD OF CONCLUSION OF THE CONTRACT
1.1. The Contract is correctly concluded with the transmission, by SP Sas, to the email address provided by the Customer, of a confirmation email (hereinafter "Order Confirmation") of the Customer's purchase order, carried out through the Site. It should be noted that the system is unable to detect errors with reference to the data entered by the Customer in the field dedicated to the addresses for billing and for shipping.
2.1 The minimum order of SP Sas is recommended at € 500.00 excluding VAT and each product has its own minimum of pieces that can be ordered.
2.2 Each order can be canceled or modified no later than 72 hours after sending the order confirmation. The customer has an obligation to communicate within 72 hours from the date of receipt of the order confirmation the request for cancellation or modification of the same by email
2.3 In case of cancellation of the order beyond the aforementioned terms, the customer will be required to pay a penalty equal to 25% of the undelivered products.
2.4 In the event of a change in order decrease beyond the aforementioned terms, the customer will be required to pay a penalty of an amount equal to 25% of the products eliminated.
2.5 In case of non-collection by the customer, after ten working days from the written communication by SP Sas that the goods are ready for delivery, the order is to be considered canceled and therefore the customer will be required to pay a penalty for an amount equal to 25% of the undelivered products.
3. PRODUCT INFORMATION
3.1 The photographs presenting the products are purely indicative, and are not part of the contractual framework. In none
case may be considered the responsibility of SP Sas
3.2 All color and size variations are an integral part of our articles and constitute the guarantee of a product
craftsmanship entirely made in Italy with hand-finished components.
3.3 Shades and color variations also over time are intrinsic characteristics of the fabric.
3.4 Small imperfections and irregularities are not defects but characteristics that make each of our articles authentic and unique.
4.1 All prices shown on the site are to be understood as excluding VAT and do not include transport costs.
4.2 SP Sas reserves the unquestionable right to make changes to the list prices at any time, even without notice, in the event that the cost components of the individual items make it necessary, but it undertakes equally to apply the prices indicated on the list at the time of placing the order.
5.1 Each new customer is required to pay by advance bank transfer or cash on delivery (cash or bank check). The transfer is a bank transaction that allows the transfer of funds from one natural or legal person (Payer) to another (Beneficiary). In order for SP Sas to proceed with the delivery of the products, the customer is required to send the CRO number (Operation Reference Code) or copy of the bank transfer note by e-mail to email@example.com.
5.2 In the event that the order includes articles modified on the basis of specific customer requests, payment of the modified articles is requested in advance within five working days from the date of the Order Confirmation by bank transfer. The amount will be indicated with the "Down payment" item in the above Order Confirmation.
6.1 Transport costs are charged to the customer, calculated in relation to the weight, volume of packages and their destination, and will be communicated in advance in the pro-forma invoice.
6.2 The free port in Italy is set at € 1,500.00 ie
6.3 The purchased products will be delivered by SP Sas to the shipping address indicated by the customer when ordering. SP Sas uses the services of various express couriers and cannot be considered responsible for the consequences due to a possible delay in delivery.
6.4 The invoice will be sent with the goods.
6.5 The delivery terms shown on the Order Confirmations are purely indicative, they are to be considered as a simple forecast of the times necessary for delivery and as such will be respected as far as possible. In no case can the contract be canceled in the event of any delays.
6.6 SP Sas grants the customer the right to collect the goods in person or using his own forwarder.
7.1 The goods travel at the customer's risk and danger and are insured only on customer's order.
7.2 We do not accept claims for missing or damaged goods after 72 hours of delivery. The customer is required to send photos of the goods by email to within this deadline.

8. DISPUTES AND LIABILITY
8.1 These General Conditions are governed by Italian laws. The Court of Bergamo will be competent for all disputes resulting from the interpretation and / or execution of these General Conditions.
